This GEM should be read in conjunction with previous advice [GEM 079/2009 refers] and the implementation date for new lump sum commutation factors.  Pension Administrators should already have received advice about this issue directly from the Home Office.
 
My previous correspondence on the matter advised that the Home Office was deliberating on whether to appeal a judicial review decision on 17 March about the date for implementation of new lump sum commutation factors for the police pension scheme.  The effect of the judgement had been stayed, pending a decision by the Home Office.
 
I can advise that the Home Office will not proceed with an appeal and that the date on which factors take effect is 1 December 2006
 
The Home Office have stated they will cover any backdated costs to Authorities.  If not contacted already, the Home Office have indicated they will be in touch with Authorities shortly about arrangements for paying these costs.
